Welcome to Ayotravel!
This agreement will be between AyoTech Yazılım Teknoloji Anonim Şirketi (referred to only as AyoTech throughout the Agreement) and all users registered on the AyoTravel platform.
As soon as you open an account in the Ayotravel application, you accept the following conditions.
Ayotravel Service is one of the AyoTech Products offered to you by AyoTech Company. These terms of use constitute a contract between you and AyoTech Company.
We agree to offer you Ayotravel service. The service includes all Ayotravel products, features, applications, services, technologies and software that we provide to advance Ayotravel's mission: The service consists of the following elements:
Ayotravel offers a service to enable travelers who love to explore the world, learn new cultures and new lives, and who are passionate about adventure, to find travel guides to tour the places they want to visit. Travel guides can be professional guides as well as people of that region. There is no relationship between travel guides and AyoTech Company. Therefore, Ayotravel and therefore AyoTech company are not responsible for any problems that may occur between travel guides and travelers. For this, it is recommended to choose a reliable travel guide for travelers.
We want our service to be as open as possible, where anyone can participate, while remaining safe, secure and legal. Therefore, you have to agree to a few restrictions before joining the Ayotravel community.
You must be at least 13 years old or the minimum legal age required to use Ayotravel in your country.
Your account must not have been previously closed for violating the law or any of our policies.
You should not have been convicted of any sexual offense.
Everyone needs to do their part to deliver a safe and open Service to the wider community.
You may not impersonate another person or provide false information.
Unless you are a travel guide at Ayotravel, you do not need to disclose your identity, but you must provide us with accurate and up-to-date information (including registration information), which may include your personal information. You also can't impersonate someone or anything else, and you can't create an account for someone without your express permission
You may not do anything that is unlawful, misleading or fraudulent, or take any action for any illegal or unauthorized purpose.
You may not do anything that will interfere with or adversely affect the intended operation of the Service.
This includes misuse of complaints, disputes or objection channels, such as making misleading or unfounded complaints or objections.
You may not attempt to create an account, access or collect information through unauthorized means.
This includes automatically creating accounts or collecting information without our express consent.
You may not sell, license, or buy any accounts or data obtained from us or our Services.
This includes any attempt to buy, sell or transfer any part of your account (including your username); This includes soliciting, collecting or using other users' login credentials or badges, or requesting or collecting Ayotravel usernames, passwords or improper access tokens.
You may not share another person's private or confidential information without permission or take any action that violates another person's rights, including intellectual property rights (e.g. copyright infringement, trademark infringement, counterfeit or pirated products).
You may use another person's work subject to any exceptions or limitations to copyright and related rights under applicable law. You represent that you own or have obtained all necessary rights to the content you post. Learn more here, including how to report content you believe violates your intellectual property rights.
You may not modify, translate, create derivative works of, or reverse engineer our products or any of their components.
Permissions You Grant to Us. Pursuant to the contract between us, you grant us the permissions we need to provide the Service.
We do not claim ownership of your content, but you grant us a license to use it.
You agree that we may download and install service updates on your device.
Once you register as a travel guide, you are responsible for the legal regulations in your home country. AyoTech company does not accept any responsibility in this regard.
If you choose a username or similar identifier for your account, we may change them as we see fit or necessary (e.g. if it violates someone else's intellectual property rights or impersonates another user).
When you use content that is covered by our intellectual property rights and make them accessible on our Service (for example, the images, designs, videos or sounds we provide for you to add to the content you create or share), we retain all rights to the content we own and we do not give you any rights to that content.
You may use our intellectual property, trademarks or similar marks only as expressly permitted in our Brand Guidelines or with our prior written consent.
To modify our software, create derivatives, decompile, or otherwise attempt to extract source code from us, you must first obtain written permission from us or under an open source license.
AyoTravel application is an application that brings travel guides and travelers together. Travel guides are required to act in accordance with the tax law of the country where they are located. Since the AyoTravel application does not interfere with the earnings of the travel guides, the guides should take care of this themselves. AyoTravel application and AyoTech company are not responsible for any trouble that may arise due to this.
We may remove content or information you post on the Service if we believe it violates these Terms of Use or our principles (including our Ayotravel Community Guidelines), or as permitted or required by law. To put us at risk of exposure to legal processes, to violate these Terms of Use or our principles (including our Ayotravel Community Guidelines), to continuously violate other people's intellectual property rights, or to protect our community or services as permitted or required by law. we may immediately stop or refuse to offer, in whole or in part (this includes termination of your access to Ayotech Products and Ayotech Company Products). In addition, if we determine that doing so is reasonably necessary to prevent or reduce any legal or regulatory negative impact on us, we may terminate or change the Service, or remove or block content or information shared on our Service, or stop providing all or part of the Service. If you think your account has been accidentally closed, or if you want to close or permanently delete your account yourself, check out the settings menu. When you request the deletion of your content or your account, the deletion process takes place immediately. There is no turning back after this stage.
If you delete or close your account, these Terms will no longer constitute a contract between us. However, this section and the section below titled "Our Agreement and What to Be Taken In Case of Dispute" will continue to be valid even after your account has been closed or deleted.
Any change or waiver of our contract must be made and signed in writing by us. If we fail to enforce any provision of this agreement, this will not be considered a waiver.
All rights not expressly granted to you are reserved by us.
This agreement does not grant any rights to any third party.
You cannot transfer your rights or obligations under this agreement to others without our consent.
We can transfer our rights and obligations to others. For example, such a situation may occur if the owner of our company changes (merger, sale or sale of assets) or by law.
Our service is provided "as is". We cannot guarantee that our service will always be safe and secure or flawless. TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WARRANTY OF NON-INFRINGEMENT, INCLUDING ANY WARRANTY, EXPRESS OR IMPLIED.
We also do not control what people and others do or say, and we are not responsible for their or your actions and behavior (on or off the internet) or any content you post (including illegal or offensive content). In addition, we cannot be held responsible for services and features offered by other persons or companies, even if you access it through our Service.
Our liability (also called "liability") for anything that happens in the service is limited to the minimum liability permitted by law. If any problem occurs with our service, we will not be able to know all the effects this issue may cause. Even if we know it is possible, you agree that we will not be held liable ("liable") for any special, indirect, exemplary, punitive or incidental damages arising from or related to these Terms, or any loss of profit, income, information or data. This includes when we delete content, information or your account.
We can change our service and policies. In addition, we may need to change these Terms to accurately reflect our Service and our policies. Unless otherwise required by law, we will notify you before making changes to these Terms (eg through our Service) and give you the opportunity to review before the Terms take effect. If you continue to use the Service afterwards, you will be subject to the updated Terms. If you do not want to accept these or updated Terms, you can delete your account.
